Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Sections 379, 411 of the Indian Penal Code. Allegedly, informant's Santo car was stolen.

The main submissions advanced by the learned counsel for the petitioner are that petitioner is not named in the FIR, FIR was lodged against unknown persons, during investigation petitioner's role in the alleged crime surfaced in the statement of co-accused given before the police which has no evidentiary value, after arrest of the petitioner, nothing as alleged was recovered from his possession and he has been languishing in jail since 04.01.2022 having clean antecedent.

Patna High Court CR. MISC. No.10223 of 2022(2) dt.06-07-2022 2/2 Learned APP opposes the prayer for bail.

In view of above submissions, considering petitioner's clean antecedent as mentioned at para 3 of the petition and his custody period, let the petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Arwal in Kurtha P.S Case No. 35 of 2021.
