2. Petitioner apprehends arrest in a case registered for the offences punishable under Section 382/34 of the Indian Penal Code.

3. As per the prosecution case, on 14.07.2021 at about 10:30 AM, when the informant was returning from the ATM after withdrawing Rs. 30,000/-, three unknown miscreants snatched away his money. When the informant returned back, he was told by the nearby people that the motorcycle bearing Registration No. BR06CQ3972 standing there belongs to the accused persons. The informant handed over the said motorcycle to the SHO, Laheriasarai Police Station.

4. Learned counsel for the petitioner submits that

Patna High Court CR. MISC. No.13785 of 2024(3) dt.29-04-2024 2/2 petitioner is not named in the F.I.R. and he has been made accused merely because he is owner of the motorcycle in question.

5. Learned A.P.P. for the State opposed the prayer for bail.

6. Considering the fact that petitioner is owner of the motorcycle in question, prayer for anticipatory bail of the petitioner is refused.
