JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-01-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners are named in the first information report but according to prosecution case itself, it was co-accused Alok Yadav @ Prem Lal Yadav who took the informant's son and daughter-in-law on motorcycle. So far as petitioners are concerned, only suspicion has been raised against them. The learned Sessions Judge has passed detailed order while rejecting the prayer for bail of the petitioners but he failed to refer sufficient material to show the involvement of the petitioners in the alleged crime. The impugned order reveals that only suspicion has been raised against the petitioners even in course of investigation.
Patna High Court Cr.Misc. No.58016 of 2015 (2) dt.04-01-2016 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioners, namely, Sunil Mandal, Binod Mandal and Goutam Mandal be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of C.J.M., Saharsa in connection with Basnahi P.S. Case No.67 of 2015.
