JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 08-02-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor.

Though, petitioner has got chequered history and happens to be an accused in nine cases since before institution of this case, all relating to excise act along with other allied Sections of I.P.C. The present one relates with recovery of 1800 liters of sprit in absence of petitioner. From Para-6 of the seizure list, it is evident that recovery was not made from a fix point rather it was from adjoining places near Kali Sthan.

In the aforesaid background as well as taking into account the period of custody of petitioner since 30.09.2015, petitioner, Mani Singh is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two

No.58545 of 2015 (02) dt.08-02-2016 sureties of the like amount each to the satisfaction of Mr. Manoj Kumar, Judicial Magistrate, 1st Class, Siwan in connection with Nautan P. S. Case no.132 of 2015, subject to condition that one of the bailors shall be a government servant, who will give an undertaking before the learned lower court that henceforth petitioner will not be indulged in any kind of activity relating to spurious wine. The learned lower court before acceptance of bail bond will ascertain the identity of the bailor to be a government servant.
