JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-02-2019 Earlier prayer for bail of the petitioners was dismissed vide order dated 12.12.2018 passed in Cr.Misc. No. 71666 of 2018 and there is allegation of recovery of 600 litres of Jharkhand made liquor.

Submission of learned counsel for the petitioners is that petitioners are neither the owner nor driver of the vehicle from which, the alleged recovery was made. Moreover, they have remained in judicial custody for more than four months and are ready to abide by any condition imposed on him. Heard learned A.P.P. also.

Having heard both sides, in view of the above facts, let the petitioners above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand)

Patna High Court Cr.Misc. No.9246 of 2019(2) dt.21-02-2019 2/2 each with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Gaya, in connection with Amas P.S. Case No. 220 of 2018, subject to the condition that petitioners will cooperate in disposal of trial and make themselves available as and when required by the court below, failing which, the prosecution shall move for cancellation of their bail bonds.
