Case No. 289 of 2018 instituted for the offences under Sections 414, 427/34 of the Indian Penal Code and Sections 30(a), 32(2), 41(1) of the Bihar Prohibition & Excise Act, 2016.
619.924 litres of liquor is said to have been recovered from a bolero vehicle. One person was arrested along with the consignment of liquor who disclosed that the vehicle in question was being driven by the petitioner.
The learned counsel for the petitioner submits that this statement is incorrect. The petitioner was
Patna High Court CR. MISC. No.11410 of 2020(2) dt.03-03-2020 2/2 arrested in a different case and because of such implication in the present case, he has been remanded in the present case also.
Though the petitioner is stated to have been made accused in four other cases of similar nature but the accusation in those cases are also stated to be of similar type i.e. on suspicion.
Regard being had to the period of custody of the petitioner which is from 26.10.2019 and the nature of accusation, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousands) with sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum-Excise Court, Vaishali at Hajipur in connection with Goroul P.S.
