ANJANA MISHRA ORAL ORDER 21-04-2016 Heard learned counsel for the petitioner, learned counsel appearing on behalf of B.S.F.C. and learned counsel appearing on behalf of the State.
The petitioner is apprehending his arrest in connection with Sasaram (T) P. S. Case No. 1178/2015 registered for the offences punishable under Sections 409 and 420 of the Indian Penal Code.
Learned counsel for the petitioner submits that an allegation has been made against him of defalcation of 97.60 quintals of CMR amounting to a sum of Rs.211358.66 forwhich the petitioner had entered into an agreement with the BSFC. It is further
Patna High Court Cr.Misc. No.2246 of 2016 (4) dt.21-04-2016 2/2 submitted that the petitioner is willing to pay 20 % of the alleged amount subject to the result of the case.
Considering the aforementioned bonafide offer made by the petitioner that he shall deposit the aforesaid 20 % amount within a period of one month and after depositing the said amount the above named petitioner, in the event of his arrest or surrender before the Court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on furnishing bail bond of Rs. 10,000/- ( Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Rohtas at Sasaram (T) P.S. Case No. 1178/2015, subject to condition as laid down under Section 438
(2) of Cr. P.C.
