The petitioner seeks regular bail in connection with Excise Case No. 198 of 2018 in Excise Act No. 1715 of 2018 registered for the offence punishable under Section 30(A) of the Bihar Prohibition and Excise Act, 2016.

The allegation is regarding recovery of 276 litrers of illicit liquor from a Bolero vehicle belonging to the co-accused, namely, Ravi Kumar Raman. As far as the petitioner is concerned, he was driving the said Bolero vehicle. The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case. The petitioner is admittedly stated to be driver of the vehicle, hence he cannot be made responsible for the recovery of illicit liquor. Lastly, it is submitted that the petitioner is languishing in custody since 26.12.2018.

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions JudgeIInd, Special Judge, Excise Act, Madhepura in connection with Excise Case No. 198 of 2018 in Excise Act No. 1715 of 2018.
