JUSTICE BIRENDRA KUMAR ORAL ORDER 19-04-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
Petitioner is languishing in custody for the offences punishable under Sections 147, 148, 149, 341, 323 and 504 of the Indian Penal Code and Section 27 of the Arms Act. Allegation is that the petitioner and other co-accused were firing just to terrorize the people specially the informant and others.
Learned counsel for the State submits that there is no eye witness to the occurrence which would be evident from the case diary and the petitioner has falsely been implicated due to previous enmity.
Considering the facts and circumstances of the case,
Patna High Court Cr.Misc. No.11378 of 2017 (4) dt.19-04-2017 let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-1st Class, Siwan/Successor Court, in connection with Asaon P.S. Case No.50 of 2016, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court below shall be at liberty to take steps for cancellation of the bail bonds of the petitioner in this case.
