JUSTICE ARUN KUMAR ORAL ORDER 15-03-2017 Heard learned counsel for the petitioner and learned APP appearing on behalf of the State.
Petitioner, already in custody, seeks bail in connection with Magadh University P.S. Case No.74 of 2016, registered under Sections 304(B), 120(B)/34 of the Indian Penal Code.
Allegation is that the informant's daughter, who happens to be the wife of the petitioner, is alleged to have been killed by the accused persons in connection with demand of dowry.
Learned counsel for the petitioner submits that the petitioner was married in the year 2010 and earlier there was no allegation of torture or demand of dowry and the deceased died of
Patna High Court Cr.Misc. No.11429 of 2017 (2) dt.15-03-2017 2 / 2 brain haemorrhage due to hypertension. The information of death was given to the informant and the post-mortem report clearly shows no external mechanical ante-mortem injury over any part of the body and death is due to spontaneous intra cerebral haemorrhage moreover charge-sheet has also been submitted in this case.
Having considered the said facts and circumstances, petitioner Awadhesh Yadav @ Abdhesh Yadav @ Awadhesh Kumar Yadav is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned 6th Additional Sessions Judge, Gaya in connection with Magadh University P.S. Case No.74 of 2016.
