Mr.Rajendra Nath Jha ====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 29-02-2020 Heard the learned counsel for the petitioners and the learned A.P.P. for the State.

This is an application for grant of anticipatory bail in connection with Powakhali case no. 60 of 2019 registered for the offences punishable under Sections 353, 186 and other sections Indian Penal Code.

The allegation is regarding the petitioners having obstructed the police in discharge of their duties and were trying to forcibly install a pillar on the public way. It is further alleged

Patna High Court CR. MISC. No.8822 of 2020(2) dt.29-02-2020 2/2 that the accused persons including the petitioners herein had assaulted the police personnel and tried to snatch their arms. The learned counsel for the petitioners has submitted that the petitioners are innocent and have been falsely implicated in the present case. It is further submitted that the petitioners are having clean antecedent, however in order to seek anticipatory bail, they are ready to deposit a sum of Rs. 5,000/- each before the learned trial court. Having regard to the facts and circumstances of the case and considering the submissions made by the learned counsel for the petitioners, I deem it fit and appropriate to direct for release of the petitioners on anticipatory bail subject to deposit of a sum of Rs. 5,000/- each by the petitioners before the learned Civil Court Kishanganj as also subject to such conditions, as may be deemed fit and proper to be imposed by the learned court J.M. 1st class, Kishanganj in connection with Powakhali PS case no. 60 of 2019.

The present petition stands disposed off on the aforesaid terms.
