JUSTICE SANJAY PRIYA ORAL ORDER 18-04-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Nardiganj P.S. Case No. 136 of 2016 instituted for the offence under Section 395 of the Indian Penal Code.

It has been submitted that the petitioner is in custody since 15.12.2016. There is no recovery from conscious possession of the petitioner. He has been involved on basis of confessional statement made after his arrest in Wazirganj P.S. Case No. 364 of 2016.

From the written report it appears that the petitioner is not named in the written report.

In the impugned order it has come that in paragraph-35 of the case diary the police got information from Wazirganj P.S. that three criminals were caught hold and on interrogation, they

No.13025 of 2017 (2) dt.18-04-2017 2/2 told that they committed loot in the jewelry shop and, thereafter, the confessional statement of the petitioner has been recorded by the police as recorded in paragraph-37 of the case diary. Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, VI, Nawadah, in connection with Nardiganj P.S.
