Heard learned counsel for the petitioner and learned APP for the State.

The petitioner has preferred this application for grant of regular bail in a case registered under section 392 of the Indian Penal Code Allegation against the petitioner is that a motorcycle with cash of Rs.1,90,000/- was taken away by the three unknown miscreants on the point of pistol.

Learned counsel for the petitioner has submitted that the petitioner is innocent and he has falsely been implicated in this case. Nothing has been recovered from the conscious

Patna High Court CR. MISC. No.10544 of 2022(2) dt.29-06-2022 2/2 possession of the petitioner. The name of the petitioner has sprung up on the confessional statement of co-accused, Rahul Ansari. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 23.10.2021.

Learned A.P.P. for the State has opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances, the petitioner above-named, is directed to be enlarged on bail on his furnishing bail-bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. VIth, Begusarai, in connection with Bakhri, P.S. Case No. 188 of 2021, with a condition that the petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner will liable to be cancelled.

The application stands allowed.
