In this case, the petitioner is seeking anticipatory bail in connection with Excise Case no. 1680 of 2018 arising out of Chouri P.S. Case no. 92 of 2018, registered for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Allegation has been made that 20 litres of illegal liquor has been recovered near motorcycle of the petitioner. Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent.

Considering the quantum of liquor recovered, let the above-named petitioner, be released on anticipatory bail in

No.9305 of 2019(2) dt.18-02-2019 2/2 the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the 4th Additional Sessions Judge-cum-Special Judge, Excise Act, Bhojpur, Ara, in connection with Excise Case no. 1680 of 2018 arising out of Chouri P.S. Case no. 92 of 2018, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure. Further condition is that if the petitioner, after his release in this case, is again found involved in similar nature of cases, then the cornered Court below would be at liberty to take steps for cancellation of his bail bonds.
