JUSTICE SUDHIR SINGH ORAL ORDER 19-04-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offences under Sections 379, 411, 414, 401, 403 and 413/34 of the I.P.C.

Earlier the bail application of the petitioner was rejected vide Annexure-1 to the present application with the observation 'at this stage'.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 8.4.2016. He has remained in custody for more than a year. The case is triable by the court of Magistrate. There is no allegation of tampering of witnesses alleged against the petitioner. Charge has already been framed.

Patna High Court Cr.Misc. No.10072 of 2017 (3) dt.19-04-2017 2/2 There is no likelihood of being the trial concluded in near future. The petitioner has been made accused in the present case due to mistake of fact. The recovery of stolen motorcycle from his possession is denied by him.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J. VII, Madhubani in connection with Madhubani Town P.S. case No.141 of 2016 (G.R. No.770 of 2016) corresponding to S.T. No.422 of 2016.
