The petitioner in the present case is seeking following reliefs:- "That, this writ application is being filed for issuance of a writ in the nature of Mandamus or any other writ/writs, order/orders, direction/directions for enquired the matter properly and recovery of victim lady who is wife of petitioner in connection with Marhaurah (Gaura) O.P. P.S. Case No. 97 of 2019 under Sections 364/34 of the IPC and further any other writ/writs, direction/directions, be issued for which the petitioner is found entitled by this Hon'ble Court, as may deem fit and proper in the facts and circumstances of the case."

Having regard to the statements made in paragraph '8'

Patna High Court CR. WJC No.255 of 2022(4) dt.12-12-2022 2/2 of the counter affidavit wherein it is stated that after registration of FIR, the victim lady was recovered and she has made statement under Section 164 Cr.P.C. that she had not been kidnapped, rather had left her house voluntarily, this Court finds that this writ application has become infructuous.
