====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR SINHA ORAL ORDER 28-03-2025 Heard learned Counsel for the petitioners and learned Additional Public Prosecutor for the State.

2. This application, for grant of anticipatory bail, arises out of Atari Police Station Case No. 295 of 2024, disclosing offences under Sections 191(2), 191(3), 190(3), 126(2), 115(2), 115,(2), 109, 352, 351(2) of B.N.S. and 27 of the Arms Act.

The prosecution case, as per the First Information Report, is that on 28.08.2024, in the afternoon, while the informant was going towards his field, he saw that all the accused persons were cutting the ridge of the informant's field and were expanding the area of the field. When the informant opposed, the accused persons started abusing and assaulting him and his brother. Petitioner no. 1 Manoranjan Kumar assaulted the informant with khanti and when his brother intervened, coaccused Ritu Raj, Saurabh Kumar assaulted the brother of the informant.

4. Learned Counsel for the petitioners submits that both the parties are co-villagers and there is land dispute between them as is evident from the First Information Report itself. A counter case has been lodged by the side of the petitioners bearing Atari Police Case No. 294 of 2024 against the informant and others. The injuries sustained by the informant and his brother are simple in nature. The side of the petitioners have also sustained injury, but their injuries are also simple in nature.

5. Having regard to the submissions made by the parties and taking into consideration the fact that both the parties are co-villager, having land dispute, case and counter

Patna High Court CR. MISC. No.11321 of 2025(2) dt.28-03-2025 3/3 case is there and injuries sustained by the victims are simple in nature, I am inclined to grant the petitioners privilege of anticipatory bail.

6. This application is, accordingly, allowed.

7. Let the petitioners, above named, in the event of their arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge-XVII, Gaya, in connection with Atari Police Station Case No. 295 of 2024, subject to the condition laid down under Section 482 (2) of the B.N.S.S.
