The Petitioner seeks bail in Dehri (Town) P.S. Case No. 18 of 2017 instituted for the offence under Section(s) 272, 273 of the Indian Penal Code and Sections 30(i), 37(i)(ii), 38(i)(ii), and 41(i)(ii) of the Bihar Excise and Prohibition Act, 2016.
It is alleged that 320 litres of country made liquor and 50 litres of foreign liquor were recovered from furniture shop of this petitioner.
A supplementary affidavit has been filed on behalf of the petitioner and it has been submitted on the basis of
Patna High Court Cr.Misc. No.14757 of 2017 (2) dt.26-04-2017 2/2 Annexure-2 series of the supplementary affidavit that the aforesaid furniture shop does not belong to this petitioner, rather the furniture shop is in the name of Jitendra Kumar son of Kameshwar Sharma.
The petitioner is said to be in custody since 11.01.2017.
In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the Petitioner, above named, be released on bail on furnishing bail bond of 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Dehri, Rohtas in connection with Dehri (Town) P.S. Case No. 18 of 2017, subject to the conditions that both the bailors shall be the close relative of the petitioner.
