The petitioner seeks bail in connection with Barachatti P.S. Case No. 485 of 2016, registered under Sections 420, 467, 468, 471, 414 and 120(B) of the Indian Penal Code. The accusation is that on receiving secret information about providing the forged papers to the driver of coal loaded trucks for entering into Bihar by some persons at Dobhi Check Post, the police personnel reached there, where one person was seen talking on mobile, who disclosed his name Amit Kumar Singh and he also disclosed the name of person to whom, he was talking as Naresh Ram (Petitioner) and Chhotu Kumar (Petitioner) driver and khalashi, respectively, of truck bearing

Patna High Court Cr.Misc. No.14214 of 2017 (2) dt.08-04-2017 2/2 Reg. No. JH10X-7311 for providing the necessary papers for entering into Bihar. Accordingly, the Police personnel reached near the Truck No. JH-10X-7311 from where petitioners were apprehended, who told that they are waiting since three days for necessary papers for entering the truck, on which the coal was loaded, into Bihar.

Learned counsel for the petitioners submits that the petitioners being the driver and khalasi of the truck were waiting for three days for necessary papers for entering in Bihar with coal loaded truck. The coal was loaded in Jharkhand and paper regarding purchase of coal was with them. Further submission is that petitioners having no criminal antecedent are in custody since 01.12.2016 and the Chargesheet has already been submitted against the petitioner.

Having regard to the facts and the circumstances of the case, the petitioners, above named, are directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the ACJM, Sherghati in connection with Barachatti P.S. Case No. 485 of 2016.
