According to the prosecution case itself, it was co-accused Vijay Ram who was caught on the spot and firearm was recovered from his conscious possession but the aforesaid co-accused Vijay Ram has already been granted privilege of bail by a coordinate bench of this court.

So far as petitioners are concerned, no doubt, they do criminal antecedent of several cases but in the present case there appears to be nothing against them.

Moreover, having more or less similar allegation one coaccused Sanjay Ram has already been granted privilege of bail. Accordingly, petitioners are directed to be released on bail
