The petitioner is languishing in custody for the offence punishable under Sections 302/34 of the Indian Penal Code.

Marriage of this petitioner was solemnized in the year 2005 with Sujata Kumari. Allegation is that the petitioner committed dowry death on 29.04.2017.

Submission of learned counsel for the petitioner is that for the occurrence of death on 29.04.2017, FIR was lodged on 12.05.2017. In fact the victim had sustained fire injury while cooking the food on 12.03.2017. She was immediately rushed to NMCH, Gaya and thereafter, Appolo Burns Hospital, Patna

Patna High Court CR. MISC. No.11202 of 2019(3) dt.06-05-2019 2/2 where she was undergoing treatment and after discharge, went to her parent's house where she died.

Considering the aforesaid fact, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Delha P.S. Case No. 98 of 2017, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below having immovable property.

(b) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (Birendra Kumar, J) Banti/Rajan U T
