JUSTICE DINESH KUMAR SINGH ORAL ORDER 21-01-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 161,164,165A,409,406,403,420,468,471 and 120B of the Indian Penal Code.

The prosecution case is that in 1981 fourteen lacs rupees were allocated for the repair and restoration of embankment of Budhi Gandak. The petitioner was working as contractor. It is submitted by the learned counsel for the petitioner that though the case was registered in 1982 but investigation is still pending against the petitioner. The petitioner is ready to deposit the amount alleged against him. Statement has been made

Patna High Court Cr.Misc. No.3369 of 2016 (2) dt.21-01-2016 2/2 in paragraph 3 of the petition that the petitioner has no criminal antecedent.

Considering the fact that the case was registered in 1982, this court is not inclined to interfere in the matter. However, let the learned court below consider the prayer for regular bail of the petitioner if the petitioner undertakes to deposit the alleged amount in case the petitioner surrenders within six weeks from today in connection with Pakaridyal P.S. Case No. 10 of 1982 pending in the court of learned SDJM, Sikarahana, Motihari, East Champaran.

This application is disposed of with the aforesaid observation/direction.
