JUSTICE DINESH KUMAR SINGH ORAL ORDER 04-01-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 419, 420, 467, 468, 471, 147, 149, 353, 332, 337, 307 of the Indian Penal Code and 3/4 of The Prevention of Damage to Public Property Act.

The prosecution case is that the informant being the Block Development Officer, Parbatta along with other police personnel raided the electric shop of co-accused Ashok Kumar Sharma and seized some government papers from there. It is further alleged that co-accused Ashok Kumar Sharma called his supporters including the petitioner, who put hindrance in making seizure and scuffled with the raiding party, pelted bricks and damaged the government jeep.

Patna High Court Cr.Misc. No.57990 of 2015 (2) dt.04-01-2016 2/2 It is submitted by learned counsel for the petitioner that the thrust of accusation is against co-accused Ashok Kumar Sharma. The accusation is not specific against the petitioner. Moreover, a statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Khagaria in connection with Parbatta P.S. Case No.296/2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
