The petitioners apprehend their arrest in connection with a case registered for the offences punishable under Sections 447/ 376/511/504/506 and 34 of the Indian Penal Code and Section 8 of Protection of Children from Sexual Offences Act, 2012 (POSCO). Learned counsel for the petitioner submits that admittedly, as per the First Information Report itself, the main allegation is against one Binod Mahto and not against these petitioners. He further submits that on account of a petty dispute regarding grazing of informant's goat in the vegetable field of the petitioners, false and frivolous allegations has been made against these petitioners
Patna High Court Cr.Misc. No.3548 of 2016 (2) dt.18-02-2016 P2/2 and son of the petitioner No. 4.
Considering the nature of allegations made and after perusing all materials on record and also because these petitioners have no criminal antecedent, let the petitioners abovenamed, in the event of their arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the each amount to the satisfaction of the learned Chief Judicial Magistrate, Bhagalpur in connection with Ishipur Barahat P.S. Case No. 121/2014 subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Anjana Mishra, J) Saif/- U T
