Heard learned counsel for the parties and perused the case diary.
Petitioner apprehends arrest in a case registered for the offences punishable under Section 307 and other allied sections of the Indian Penal Code.
Prosecution's case, in brief, is that the petitioner assaulted the informant by iron rod causing injury on his head and hand.
Learned counsel appearing for the petitioner submits that the petitioner has falsely been implicated in this case. Petitioner and informant are co-villagers and the alleged occurrence took place on the little issue of non-payment of price of eggs by the informant for which petitioner has also lodged a case against the informant. It is also the case of the petitioner that there is no allegation of giving repeated blow by the petitioner. Moreover, for the occurrence dated 17.10.2019, the injury report dated 24.11.2019 records that X-ray Report has not been submitted, so opinion is reserved. Petitioner has got no criminal antecedent.
Considering the facts of the case, let the petitioner,
Patna High Court CR. MISC. No.11109 of 2020(3) dt.17-06-2020 2/2 above named, in the event of surrender before the Court below be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate 1st class, Gopalganj in Baikunthpur Police Station Case No. 266 of 2019, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
