JUSTICE JYOTI SARAN ORAL ORDER 30-11-2016 Considering that the petitioner had earlier moved for the same relief albeit against a different rejection order refusing his prayer for voluntary retirement and which writ petition was dismissed vide order enclosed at Annexure 'B' to the counter affidavit of the State but he has not disclosed this fact in the writ petition trying to hide behind under the impugned order to submit that he had not earlier moved against the impugned order, the writ petition suffers from suppression of fact and for non-disclosure of the same, I am not persuaded to exercise my discretion under Article 226 of the Constitution of India. The petitioner should have disclosed all facts while seeking his remedy for voluntary retirement.
