The petitioner is apprehending his arrest in connection with Sarairanjan P.S.Case No. 118 of 2015 for the offences punishable under Sections 147, 149, 341, 323, 307, 447, 379 and 504 of the Indian Penal Code.

Learned counsel for the petitioner submits that at the spur of moment the altercation took place on account of construction of boundary wall and both the parties have sustained injuries. Though there is specific allegation that the petitioner has assaulted the informant with iron rod the injuries are simple in nature. Considering the entire facts and circumstances of the case and that altercation took place at the spur of moment during construction of boundary wall, let the above named

No.57492 of 2015 (2) dt.05-01-2016 2/2 petitioner, in the event of his arrest/surrender in the court below within four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Sankash Chandra, learned Judicial Magistrate, 1st class, Samastipur, in connection with Sarairanjan P.S.Case No. 118 of 2015,subject to the conditions as laid down u/s 438(2) Cr.P.C.
