The petitioners are apprehending their arrest in connection with Bachhwara P.S.Case No.157 of 2018 , registered for offences punishable under Sections 143,342, 323, 307, 379, 504, 506 of the Indian Penal Code.

Allegation against the petitioners is that they came armed with Lathi, Danda and Farsa and threatened the informant and when the informant was trying to solve the matter through social mediation, the accused persons came and assaulted by Lathi, Danada and Farsa causing injury to them.

Submission of the learned counsel for the petitioners is that there was partition suit between the parties and that has

Patna High Court CR. MISC. No.10793 of 2019(4) dt.09-05-2019 2/2 been decided in favour of the petitioner and due to that they have falsely been implicated in this case and the injuries are simple in nature.

Heard learned A.P.P. , who has opposed the prayer for bail stating that some of the injuries were kept reserved earlier. Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioners, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned ACJM VI, Begusaai in connection with Bachhwara P.S.Case no.157 of 2018, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure.

With the aforesaid direction, this application is allowed.
