The petitioner, who is in custody, seeks bail in connection with Awatar Nagar P.S.Case No. 209 of 2016 registered under Sections 188, 272 and 273 of the Indian penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Allegation in brief is that 10 litres of illicit country made liquor were recovered from the house of the petitioner. It is submitted that the petitioner is a poor old man and neither anything has been recovered nor copy of the seizure list was given to him or any of his family members and he has been in custody since 15.12.2016 having no criminal antecedent. Having considered the aforesaid facts and

No.6770 of 2017 (2) dt.16-02-2017 2/2 circumstances, the petitioner, named above, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-XI, Saran at Chapra in connection with Awatar Nagar P.S.Case No. 209 of 2016.
