Learned counsel appearing on behalf of the petitioner submits that he has received instruction that the petitioner will file detail representation before the Divisional Commissioner, Bhagalpur Division, Bhagalpur with respect to the claim prayed for in the present writ petition. However, it is found that the disciplinary proceeding is pending against the petitioner. The same is required to be disposed of expeditiously.

3. Considering the specific submission of the learned counsel for the petitioner that petitioner seeks to file detail representation before the Divisional Commissioner, Bhagalpur Division, Bhagalpur with respect to the relief sought for in the present writ petition, the Divisional Commissioner, Bhagalpur Division, Bhagalpur is directed to dispose of the representation of the petitioner within a period of six weeks from the date of its filing in accordance with law and ensure payment of pensionary benefit to which the petitioner is entitle within the aforesaid period with statutory interest till date of payment.
