JUSTICE BIRENDRA KUMAR ORAL ORDER 29-03-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 363/366A/34 of the Indian Penal Code.
Allegation is of kidnapping of Sangita Kumari, a minor girl. The victim girl in her statement, under Section 164 Cr.P.C., supported the allegation that she was forcefully taken away by petitioner Arvind Kumar and Rahu Kumar because Arvind Kumar wanted to marry with her. She was taken to different places, however, nothing more happened against her. Submission is that the matter is of love-affairs, however, due to pressure of the family the victim girl has given

Considering the facts aforesaid, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Daudnagar, Aurangabad/Successor Court, in connection with Goh P.S. Case No.66 of 2016, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
