The petitioner has prayed for regular bail in a case instituted for the offence under Sections 498A/34 of the Indian Penal Code and Sections 3⁄4 of the Dowry Prohibition Act. The allegation against the petitioner along with others is of torturing the informant due to non-fulfillment of further dowry demand of Rs. 1,50,000/-. It is further alleged that when the informant refused to the same, she was assaulted by them due to which her pregnancy was aborted thereafter, the petitioner has solemnized his second marriage. It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. He has committed no offence. He submitted that the petitioner is the

There is general and omnibus allegation against the petitioner and other co-accused persons of demanding of dowry and torture. He submitted that the petitioner is ready to keep the informant as a wife with full dignity and honour, if she is ready. Petitioner has got no criminal antecedent as stated in para-3 of the bail petition. He is languishing in judicial custody since 02.09.2022. The application for bail is opposed by learned APP for the State.
Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Madhepura in connection with Shri Nagar P.S. Case No. 82 of 2022.
