Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending his arrest in connection with Sahiyara P.S. Case No.74 of 2019, registered for the offences punishable under Sections 25(1-b)a/26/35 of the Arms Act.

Petitioner was not there at the time of recovery of firearm from the co-accused. The co-accused disclosed the name of the petitioner. The petitioner has got criminal antecedents. Though there is no direct material against the petitioner, however, considering criminal antecedents of the petitioner, I am not inclined to grant anticipatory bail to the

Patna High Court CR. MISC. No.21666 of 2021(2) dt.30-11-2021 2/2 petitioner. Hence, the prayer for anticipatory bail is refused. However, in the event of surrender of the petitioner within two weeks, the prayer for regular bail shall be considered without being prejudiced by the order of this Court.
