The petitioners seek bail in connection with Birpur (Balua Bajar) P.S. Case No. 179 of 2016, registered under Sections 147 and 379 of the Indian Penal Code and Sections 47, 57 and 64 of the Bihar Excise Act, 2016.
Learned counsel for the petitioners submits that it would appear from the F.I.R. that petitioners were not apprehended by the police on spot and nothing was recovered from their possession. The name of the petitioners surfaced in rumor about carrying Nepali liquor from Nepal. Further
Patna High Court Cr.Misc. No.15078 of 2017 (2) dt.20-04-2017 submission is that petitioners have no criminal antecedent and are in custody since 18.01.2017.
Having regard to the facts and the circumstances of the case, the petitioners above named, are directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Birpur (District- Supaul), in connection with Birpur (Balua Bajar) P.S. Case No. 179 of 2016. Out of two sureties, one surety must be the close relative of the petitioner.
