The petitioner has preferred this application for grant of regular bail in a case registered under section 392 of the Indian Penal Code to which sections 395 and 412 of the Indian Penal Code were added subsequently.

As per the prosecution case, three accused persons on a motorcycle over took the informant and snatched his bag containing over Rs. 8.6 lacs in cash.

It is submitted by learned counsel for the petitioner that the FIR was registered against unknown. The name of the petitioner transpired in course of investigation in the confessional statement of a co-accused and subsequently Rs. 2.42 lacs is shown to have been recovered from the petitioner's house. It is categorically denied that the said amount has any

Patna High Court CR. MISC. No.20670 of 2021(6) dt.08-12-2021 2/2 connection with the looted money of the informant. The petitioner inspite of being in custody since 27.8.2020 has not been put on T.I. Parade. It is further submitted that a supplementary affidavit has been filed stating therein that it was subsequent to his arrest in the present case that the petitioner has been remanded in two other cases.

Having heard learned counsel for the parties and taking into consideration the facts of the case together with the petitioner having remained in custody for 1 year 3 months and charge sheet having been submitted in the case, the Court directs the petitioner to be enlarged on bail in connection with Rajauli P.S. Case no. 404 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nawada.
