JUSTICE PRABHAT KUMAR JHA ORAL ORDER 31-07-2018 Heard Mr. S.S. Dwivedi, the learned senior counsel for the petitioner and the learned counsel for the State. This writ petition is filed for a direction to the respondents to issue rent receipt in favour of the petitioner as Jamabandi was created in the name of her husband vide Misc. Case No. 24 (VIII D) of 1966-67 on 17.04.1967 on the basis of settlement made by ex-landlord in favour of the husband and brother of the husband of the petitioner and since then the petitioner was paying rent till the year 2007 and rent receipt was issued but the Circle Officer directed the Revenue Karmchari not to issue rent receipts.

Patna High Court CWJC No.5058 of 2018 (2) dt.31-07-2018 2/2 Admittedly, vide Annexure-2, on the petition of Raja Ram Chaudhary, Jamabandi was opened in his name vide order dated 17.04.1967 passed in Misc. Case No. 24 (VIII D) of 196667. Raja Ram Chaudhary died. The Revenue authority used to issue rent receipts in the name of Raja Ram Chaudhary and it appears that rent receipts were also issued in favour of Raja Ram Chaudhary on 22.03.2007.

Taking into consideration the facts aforesaid, I dispose of this writ petition with a direction to the Circle officer that if a petition is filed by the petitioner to get her name mutated with regard to the land standing in name of her husband vide Misc. Case No. 24 (VIII D) of 1966-67 on 17.04.1967, the Circle Officer shall pass order within four months from the date of presentation of such petition.
