The petitioner is languishing in custody since 09.12.2018 in a case registered for the offences punishable under Sections 379/34 of the Indian Penal Code. The prosecution case as per the written report of Indrajeet Mandal dated 05.04.2018 submitted to the Station House Officer of Pratapganj Police Station is to the effect that on 04.04.2018 the informant went to the house of his house owner by parking his Hero Honda motorcycle and when the informant came out, he saw two persons escaping with his motorcycle. One of the pillion riders was caught as he fell down from the motorcycle and received injury. Subsequently, the apprehended person named the petitioner, who escaped from the scene.

No.9569 of 2019(2) dt.18-02-2019 2/2 It is submitted by learned counsel for the petitioner that the investigation has already been concluded and there is no recovery from the possession of the petitioner. Though, the petitioner is accused in eight other cases but he is on bail in those cases.

Learned APP submits that the petitioner is named in the FIR and he has serious criminal antecedent. Considering the period under custody, there is no recovery from the possession of the petitioner and the investigation has already been concluded, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-divisional Judicial Magistrate, Birpur, Supaul in connection with Pratapganj P.S. Case No. 44 of 2018.
