This application for regular bail arises out of Sessions Trial No. 707 of 2018 arising out of Gardanibagh P.S. Case No. 310 of 2018, disclosing offences punishable under Sections 498A, 302, 120B and 34 of the Indian Penal Code. The petitioner is the husband of the deceased, they were married, as per the case of the prosecution itself, in 2008. The date of occurrence is said to be 30.07.2018, when the dead body of the deceased was found hanging with the fan. The brother of the deceased is the informant, who has alleged that there had been demand of dowry.

Learned counsel appearing on behalf of the petitioner has submitted that there is no specific allegation in the F.I.R.

Patna High Court CR. MISC. No.10602 of 2020(2) dt.02-03-2020 2/2 which can be said to be constituting an offence under Section 302 of the Indian Penal Code, against the petitioner. His implication is either based on suspicion or malafide. Considering the fact and circumstances, as noted above, this application is allowed.

Let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge-IV, Patna in connection with Sessions Trial No. 707 of 2018 arising out of Gardanibagh P.S. Case No. 310 of 2018.
