2. The petitioner apprehends his/her arrest in connection with Sangrampur P.S. Case No. 02 of 2016, registered for the offences punishable under Sections 461 and 379 of the Indian Penal Code.

3. As per allegation, when the informant went to open his shop on 05.01.2016 at 7:00 AM, he saw that locks of his shops was broken. The informant then informed to S.H.O and upon investigation it was found that Rs. 15,000/- cash from the drawer and Rs. 60,000/ cash from steel box was missing along with few more items.

4. Learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.13542 of 2024(2) dt.12-03-2024 2/2 that he has falsely been implicated in this case nothing was recovered from his possession. The name of the petitioner has surfaced in this case on the basis of confessional statement of the co-accused.

5. Learned APP has vehemently opposed the prayer for bail and submitted that the petitioner has two criminal antecedent of similar nature.

6. Considering the above-mentioned facts and circumstances, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran, Motihari in connection with Sangrampur P.S. Case No. 2 of 2016, subject to the conditions as laid down under Section 438(2) Cr.P.C.
