JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-04-2019 This application, for grant of anticipatory bail, in connection with S.T. Excise No. 572 of 2018 arising out of Triveniganj P.S. Case No. 300 of 2018, disclosing offences under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Allegation is of recovery of 120 liters of Nepali liquor from the house of the petitioner and nobody was present there.

Submission of learned counsel for the petitioner is that nothing has been recovered from the conscious possession of the petitioner and he has falsely been implicated in this case and he has no criminal antecedent.

Heard learned A.P.P. also.

Having heard both sides, in view of the facts and

No.10042 of 2019(3) dt.25-04-2019 2/2 circumstances of the case as stated above, I am not inclined to grant anticipatory bail to the petitioner, rather he should surrender and make prayer for regular bail, which will be considered on the basis of materials available on record, without being prejudice by order of this Court.

Accordingly, this application is dismissed.
