JUSTICE MOHIT KUMAR SHAH ORAL ORDER 02-03-2020 The petitioner apprehends his arrest in connection with Pakridayal P.S. Case No. 339 of 2019 for the offence punishable under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016.

After some arguments, the learned counsel for the petitioner seeks to withdraw the present petition with liberty to surrender before the learned court below and pray for regular bail in view of the bar under Section 76(2) of the Bihar Prohibition and Excise Act, 2016 regarding maintainability of an anticipatory bail petition.

Accordingly, the present petition stands disposed of as not pressed, however, with liberty to the petitioner to surrender before the learned court below and seek regular bail. It is further directed that in case the petitioner surrenders before

No.8978 of 2020(2) dt.02-03-2020 2/2 the learned court below within a period of four weeks from today and seeks regular bail, the same shall be considered and decided on the very same day by the learned court below especially considering the facts that the petitioner is having a clean antecedent and a minimal quantity of illicit liquor is stated to have been recovered from the house of the petitioner.
