JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 05-05-2023 Heard learned counsel for the petitioner and learned A.P.P appearing on behalf of the State. The petitioner is languishing in custody in a case registered for the offences punishable under Sections 419, 420, 376 of the Indian Penal Code, Section 4/8 of the POCSO Act and Sections 3, 4, 5, 7, 8 of the Immoral Traffic(Prevention) Act.

The prosecution case as per F.I.R is that in a raid led by the police officials, the petitioner along with other persons were caught in compromising position with several other women in the hotels.

The petitioner had gone along with one of his friend for lunch in the said hotel but suddenly raid was laid and the petitioner was apprehended. The girl namely Soni Kumari who was caught with the petitioner had recorded in her 164 Cr.P.C statement wherein she had not alleged that any immoral activity was done by the petitioner with her. The petitioner is languishing in custody since 29.12.2022.

Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar in connection with Buxar Mahila P.S. Case No. 66 of 2022.
