This is an application for bail in connection with Samastipur Rail P.S.Case No. 73 of 2016 registered for the offences punishable under Sections 414 of the Indian Penal Code and 20/22 of the NDPS Act.

It has been submitted on behalf of the petitioner that petitioner is a lady and nothing has been recovered from her conscious possession and she is in custody since 25.11.2016. Heard learned APP also, who has opposed the prayer for bail stating that on checking police has caught one person and beside him the petitioner was sitting and there is recovery of huge quantity of ganja and, as such, the petitioner does not deserve bail. Having heard both sides and also considering the fact

Patna High Court Cr.Misc. No.8060 of 2017 (2) dt.27-02-2017 2/2 there is recovery of huge quantity of ganja, I am not inclined to grant bail to the petitioner. However, petitioner may renew her prayer for bail after framing of charge in this case. Accordingly, this application is dismissed.
