The petitioner seeks bail in anticipation of his arrest in connection with Karamchat P.S. Case No. 5 of 2020 dated 04.02.2020 instituted for the offences under Sections 353, 409, 420 and 34 of the Indian Penal Code.
By order dated 04.01.2022, the District Magistrate, Kaimur at Bhabua was directed to file a detailed report with respect to the scheme which was to be carried out by the petitioner.
It appears from the counter affidavit that in the threemen inquiry committee report, it is indicated that though the work was faulty but it was physically complete. The petitioner is said to be the Ward Secretary of the
Patna High Court CR. MISC. No.20333 of 2021(4) dt.28-04-2022 2/2 concerned Panchayat, where, under the scheme for providing potable water, work was executed for which Rs. 50 lakhs was earmarked.
In view of the report of the three men committee constituted by the District Magistrate, Kaimur at Bhabua, referred to above, which indicates that the work has been done though not to the satisfaction of the authorities, the petitioner is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Bhabua (Kaimur) in connection with Karamchat P.S. Case No. 5 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C.
