The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 307, 379 and other allied sections of the Indian Penal Code. As per the prosecution case, on the alleged date and time of occurrence, while the construction work was going on at the house of informant, all the 13 FIR named accused persons including petitioners variously armed came at her door and started abusing. Co-accused Anil Singh demanded Rs. 1,50,000/- as Rangdari. When the informant denied, all the accused persons assaulted her. When her husband came to save

Patna High Court CR. MISC. No.10543 of 2023(2) dt.16-05-2023 2/2 her, all the accused persons assaulted him with lathi due to which he sustained head injury. All the accused persons also assaulted labourers. Co-accused Sujit Kumar snatched gold ornament from the neck of informant.

It is submitted that due to land dispute between the parties, the alleged occurrence took place in which both sides sustained injuries. There is case and counter case. The doctor has found the injuries sustained by the injured simple in nature. Considering the facts aforesaid, the petitioners abovenamed, in the event of their arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Khagaria in connection with Chautham P.S. Case No. 265 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
