Petitioner is seeking anticipatory bail in connection with Triveniganj P.S. Case No. 289 of 2018 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 307, 379 and 504 of the I.P.C.

Learned counsel for the petitioner submits that although there are allegations of assault against this petitioner on the head of the informant, but from the impugned order it will appear that as many as six injuries have been found on the body of the victim which has not been duly explained. Learned APP for the State is present and has opposed the prayer for anticipiatory bail as according to him the petitioner is not only member of the mob, but has also allegedly

Patna High Court Cr.Misc. No.10009 of 2019(2) dt.19-02-2019 2/2 assaulted the informant on his vital part of the body. Thus, it is not a fit case for grant of anticipatory bail. In the given facts and circumstances of the case wherein there are specific allegations of assault against this petitioner on the vital part of the body of the informant, this Court is not inclined to extend the privilege of anticipatory bail to the petitioner. In case, he surrenders and prays for regular bail in the court below within a period of four weeks from today, the same shall be considered with reference to the materials collected in course of investigation and shall be considered accordingly without being prejudiced by the order of this Court.
