Heard Mr. Ashok Kumar Jha, learned Advocate for the petitioners and the learned APP for the State. The petitioners seek bail in anticipation of their arrest in connection with Sakri P.S. Case No. 227 of 2021 dated 05.12.2021 instituted for the offences under Sections 341, 323, 324, 307, 354B, 504 and 34 of the Indian Penal Code. Though the accusation of assault is on all the accused persons but that is only general and omnibus. The victim has

Patna High Court CR. MISC. No.16752 of 2022(2) dt.17-05-2022 2/2 received two injuries, one on his little finger and the other on the parietal region, but both the injuries have been opined to be simple in nature.

There is a counter version of the occurrence, which has been lodged by petitioner no. 4, in which some of the persons from the side of the petitioners have also been injured. It has further been submitted that prior to the aforesaid case and counter case, there was yet another case lodged by petitioner no. 3 against the informant and others vide Sakri P.S. Case No. 218 of 2021.

Considering the afore-noted background facts, the petitioners are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on their furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Madhubani in connection with Sakri P.S. Case No. 227 of 2021, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Ashutosh Kumar, J) krishna/- U T
