The petitioners have prayed for regular bail in a case registered for the offence punishable under sections 341, 323, 324, 307, 504, 34 of the Indian Penal Code later on Section 302 was also added.

As per prosecution case, the allegation against the accused persons including the petitioners is that they assaulted to the brother of the informant. It is further alleged that co-accused, namely, Sumit Singh assaulted by means of knife due to which he sustained injury on his

Learned counsel for the petitioners submit that the petitioners are innocent and have committed no offence. They have falsely been implicated in this case and they have got no criminal antecedent. There is no specific allegation of stabbing attributed against the petitionerd rather general and omnibus allegation attributed against them and the specific allegation of stabbing is against coaccused. As per postmortem report, which also shows only one injury has been sustained by the deceased caused by sharp edged weapon. It is further submitted that the petitioners are languishing in judicial custody since 16.10.2022.

Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioners, this court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be released on bail in connection with Nanpur P.S. Case No. 471 of 2022 on furnishing bail bond of

Patna High Court CR. MISC. No.13511 of 2023(3) dt.11-07-2023 3/3 Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Pupri, Sitamarhi.
