Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The statement of victim has been recorded u/S 164 of the Cr.P.C. in which, she stated that she was allured and after that, taken away by the petitioner. The learned Magistrate, who recorded statement of the victim, found her aged about 17 years 6 months but learned counsel for petitioner points out that the date of birth of the victim is 03-04-1995 and as a matter of fact, the victim was major on the alleged date of occurrence. It is further contended by him that there was love affair between the petitioner and the victim but when she came under clutches of her family
Patna High Court Cr.Misc. No.57015 of 2015 (2) dt.17-12-2015 2/2 members, she took "U" turn and made statement against the petitioner, who is languishing in jail custody since 22-09-2015. Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Buxar Industrial Area P.S. Case No. 199 of 2015 to the satisfaction of learned Chief Judicial Magistrate, Buxar.
