Mr.Renu Kumari ====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 20-09-2019 Heard learned counsel for the petitioner, learned counsel for the opposite party no.2 and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Complaint Case No. 1123C of 2016 registered under Section 498A of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act.

Learned counsel for the petitioner submits on the joint prayer of learned counsel for the petitioner and the opposite party no.2, the matter was referred to the Mediation Centre, Patna High Court, Patna, for settlement of dispute in between the petitioner and the opposite party no.2, who are

Patna High Court CR. MISC. No.16307 of 2019(5) dt.20-09-2019 2/2 husband and wife, where both parties appeared and settled their dispute in terms of memorandum of agreement dated 03.09.2019, which is the part of Mediator's Report dated 03.09.2019.

On the other hand, learned counsel for the opposite party no. 2 submits that at present opposite party no. 2 is living with the petitioner.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Jamui, in connection with Complaint Case No. 1123C of 2016, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
